Kelly Swartz is board certified in intellectual property law and practices in the areas of intellectual property, including patents, trademarks, copyrights and trade secrets.

In addition to protecting the intellectual property for individuals and businesses, Kelly also advises them on the optimal tax treatment for each agreement, transaction, and planning opportunity that might affect them.  Despite the complexity of tax, she works with clients to give them a plain-language explanation providing clear direction in the client’s best interest to resolve tax audits and controversial cases.

Yes, you read this right.  Kelly is a board-certified intellectual property attorney AND a tax lawyer.  She’s also funny, personable, and smart, making it easy to work with her on complex legal issues.

Kelly regularly serves as outside general counsel for small to medium-sized businesses who have legal needs but do not require a full-time in-house lawyer. She advises on a variety of legal matters important to the day-to-day running of the business, including brand protection, tax, employment issues, and review of contracts.

Kelly’s experience includes:

  • Working with startup companies to create clarity of their branding concept while developing a timeline for protecting all intellectual property assets, which maximizes protection of the assets while controlling initial capital outlay.
  • Counseling inventors regarding various strategies related to protecting and monetizing their inventions, including identifying the appropriate scope of patent protection, creating licensing strategies, drafting patent claims directed to mechanical, electrical, and software-based inventions, and establishing trade secret protocols.
  • Helping growth stage businesses identify and prioritize protection of existing intellectual property assets, including trademarks and patent eligible subject matter, to create value for the businesses and position them as strong candidates to receive investment from funders.
  • Advising small to medium-sized businesses and their owners with ongoing legal questions. She offers comprehensive legal support through a low, flat-rate monthly subscription model so owners can concentrate on managing their business.

Kelly serves as chair of the Board for weVENTURE, a non-profit organization focused on accelerating sustainable business growth for women entrepreneurs, and is vice-chair of The Florida Bar Intellectual Property Certification  committee. She has also serves on the Eau Gallie Arts District board and has previously served as a board member of the Brevard Schools Foundation, Brevard Bar Foundation, and Brevard County Bar Association. She further gives back to her community as a member of a public school advisory committee.

When Kelly is away from the office, she enjoys spending time with her family and performing with the Melbourne based improv troupe Funky Dog.
