Loan Modification, Stipulated Judgment, Cash for Keys,…What do you do?

It is best to talk to an attorney before you ever get to the point where you start falling behind on your mortgage. Having said that, if you find yourself at the point where you have already missed a mortgage payment, or several, you likely still have several options available. For the purposes of this article, we will assume that the mortgage is on your Florida homestead property.

I Have a Judgment and Now I Want to Collect. Vol. 1

A dispute arises. You make the decision to take the party you believe to be at fault to court. You file the lawsuit, go through the process and either by default, summary judgment or a final judgment after a trial, the judge awards you a money judgment for your damages and costs. Your feeling really […]

Can Information from Mediation be brought up during a case?

As previously discussed, Mediation is an avenue of possible resolution in a civil case, regardless of the amount in controversy. But what happens if you go to mediation and it doesn’t settle? Can the other side use anything you said in mediation against you in a later proceeding or a trial? Thankfully, the answer is […]

What Happens in Mediation?

Quite often professionals think of the phrase “Asset Protection” as a guaranteed, magical, infallible means of protection. Medical practice asset protection is really about maximizing litigation deterrence, optimal obstacle design work, and leveraging your power in the settlement process, as opposed to magically creating supernatural shields. The more well thought out, properly created obstacles or […]

For over four years our economy has lay dormant in the gutter.  Jobs are scarce and the few that are available offer low paying salaries with lousy company benefits.  We keep hearing the golden age ended.  No more pensions, plush company outings and other employee perks that were once taken for granted, shall employees receive.  […]
